I mean yeah, if he was going to discriminate then it would have been in his best interest to lie about it. 

 

But that's true for all discrimination. 

It's illegal for companies to make hiring decisions based on race, sex, sexual preference, ect, but it happens every day,  because as long as you aren't stupid enough to put down in writing or voice out loud your discrimination then it's extremely hard to prove in court  because most discriminations happens inside our heads and in our thoughts. 

 

This is how institutional discrimination thrives and perpetuates. 

A hiring manager decides in his/her head that they aren't going to hire anyone who looks or acts "gay", or isn't going to hire any hispanics, or isn't going to hire any overweight women, etc and he'll very likely get away with it as long as he knows how to create "plausible deniability"  in his hiring decisions, and not write out his preferences in a company email or anything.
