The SBYA provision doesn't apply here, as Cruz did NOT make or endorse the ad. Ted most certainly did not " approve this message" , in any form.

Frankly, the ad - " Meet Melania Trump, your next First Lady .. or you could support Ted Cruz on Tuesday " with a pic of a naked Melania on a fur rug might very well be a PRO Trump ad, depending on how you feel about a naked Melania as potential First Lady.
